TERMS AND CONDITIONS

1. INTRODUCTION, ACCEPTANCE AND AGE RESTRICTION Welcome to Whisky Boss. By accessing this website (whiskyboss.co.za) or placing an order, you agree to be bound by these Terms and Conditions. This agreement is governed by the laws of the Republic of South Africa.

  • Age Restriction: In compliance with the South African National Liquor Act 59 of 2003, it is an offence to sell or supply alcohol to anyone under the age of 18. By using this site and placing an order, you strictly confirm and warrant that you are at least 18 years of age.

     

2. PRODUCTS AND AVAILABILITY

  • Images & Vintages: Product images are for illustrative purposes only. Due to the collectible and vintage nature of certain premium whiskies, packaging, labels, or bottle designs may vary slightly from the images shown.

  • Stock: All orders are subject to stock availability. Many of our items are rare or limited edition. If an item is unexpectedly out of stock, we will notify you immediately and process a full refund.

  • Pricing: Prices are quoted in South African Rand (ZAR) and include VAT (if applicable), but exclude delivery costs unless otherwise stated. We reserve the right to correct pricing errors.

3. ORDERS AND PAYMENTS A valid purchase agreement is only concluded once we have successfully received your payment in full.

  • PayFast: We use PayFast as a secure third-party payment gateway. Whisky Boss does not store any credit card details. By using PayFast, you agree to their security and privacy policies.

  • We reserve the right to cancel any order if fraud is suspected, or if we reasonably believe the purchaser is under 18 years of age.

4. DELIVERY (THE COURIER GUY) We utilize The Courier Guy for nationwide deliveries of our premium products.

  • Timelines: Delivery times are estimates and are not guaranteed. Delays due to the courier, strikes, or force majeure are beyond our control.

  • Age Verification on Delivery: Our couriers may require presentation of a valid South African ID or Driver’s License upon delivery to verify the receiver is 18 years or older.

  • Risk: The risk of loss or damage to goods passes to you (the client) once the goods have been delivered to the specified delivery address. Please ensure your address details are correct. We are not liable for parcels lost due to incorrect information provided by the client.

5. REFUNDS AND RETURNS (CPA & ECTA) In accordance with the Consumer Protection Act (CPA) and ECTA, and due to the consumable nature of our products:

  • Cooling-off Period & Returns: You are entitled to cancel an order and return the goods within 14 days of receipt without penalty, strictly provided the goods are in their original, unopened packaging with all seals (cork, wax, foil) 100% intact. You are responsible for the direct cost and insurance of returning the goods via courier.

  • Defective Products: If you receive a defective or transit-damaged product, please notify us within 7 days of receipt at info@whiskyboss.co.za with photographic evidence. We will arrange for a replacement or refund.

  • Exclusions: No refunds will be processed for opened bottles or products damaged due to client negligence. Please refer to our full Refund and Returns Policy for detailed conditions.

6. PRIVACY (POPIA) We respect your privacy. Your personal information (Name, Address, Contact Number, and ID/Age verification data) is collected solely to process your order and comply with liquor licensing laws. We share this data only with essential third parties:

  1. The Courier Guy: To facilitate delivery.

  2. PayFast: To facilitate secure payment. We do not sell your data to third parties for marketing purposes.

7. INDEMNITY, LIABILITY AND RESPONSIBLE DRINKING Use of our products is at your own risk. Whisky Boss advocates for responsible drinking. We, our owners, employees, or suppliers shall not be held liable for any direct, indirect, special, or consequential damages, injuries, health issues, or losses arising from the consumption, use, or inability to use our products.

8. CHANGES TO TERMS Whisky Boss reserves the right to modify these terms at any time without prior notice. The terms applicable at the time of your order are the terms that apply.
